Litigation Analytics and Outcome Forecasting
Answer the four questions clients always ask (will we win, how long, what is it worth, what will it cost) with data from past cases, and be honest about its limits.

Clients ask lawyers the same four questions: Will we win? How long will it take? What is it worth? What will it cost? For most of the history of the profession the answers came from instinct, sometimes excellent and often overconfident. Litigation analytics answers them with data from past cases, and done honestly it makes advice more consistent, more explainable and less prone to wishful thinking. Done carelessly it is worse than instinct, because numbers look authoritative. Case data is full of traps: the cases that settle vanish, the cases still open look as if they never end, small samples masquerade as laws and the facts that mattered most were never recorded. This course teaches the work and the honesty that goes with it. It starts with what analytics can and cannot claim, then builds and audits the table of cases; reads win rates with their intervals, denominators and the paradoxes that catch careful analysts; estimates durations with open cases handled properly; turns past awards into value ranges that are not distorted by a few giant figures; forecasts a case from a base rate and scores the forecasts afterwards; and finally deals with the analysis of courts, judges and opponents, where the statistics are weak and the law and ethics bite. A capstone advises an invented client with a messy table and a decision to make. It builds on Legal Risk Quantification and Matter Economics and Pricing, and every case is invented.

What a row is, fields and a data dictionary, coding outcomes, cleaning and documenting. Practice: Case Table Audit, Code the Outcome and Spot the Data Fault.
Win rates and base rates: what a percentage can and cannot tell you→
Denominators, base rates, intervals, comparing groups, Simpson’s paradox and selection. Practice: Win Rate Explorer, Which Denominator? and Spot the Misreading.
How long it takes: durations, percentiles, open cases and honest timelines→
What to time, medians and percentiles, open cases, Kaplan–Meier, stages and honest timelines. Practice: Duration Estimator, Read the Timeline and Spot the Timing Error.
What it pays: awards, settlements, ranges and what a client can actually expect→

Forecasting a case and scoring your forecasts: from base rate to probability, and whether you were any good→
Base rate then adjustment, probabilities and ranges, recording forecasts, Brier score, calibration, overconfidence and testing models. Practice: Forecast Scoreboard, Adjust the Base Rate and Spot the Forecasting Habit.
Courts, judges, opponents and ethics: analysing people fairly, and reporting results to clients→
Forum comparisons, analysing judges and opponents, legal and ethical limits, portfolio analytics and honest reporting. Practice: Fair or Not?, Report It Honestly and Spot the Ethics Problem.
Capstone: Capstone: advising Wexcombe Fabrics on a supply dispute→
Audit a case table, read rates, estimate time and value, forecast the case, score your record and write an honest memo for the client.
What It Covers
“You will be able to put honest numbers on how cases go, say exactly how far to trust them and never let a percentage do the work of judgement.”
- Seven modules and a capstone that follow the four client questions through the data: outcomes, time, value and forecasts, with the courts and the people last, where care matters most.
- Five working tools with invented data: a Case Table Audit that finds what is wrong with a table of cases, a Win Rate Explorer with intervals and a Simpson’s paradox check, a Duration Estimator that uses open cases honestly, an Award Range Finder that is not fooled by outliers, and a Forecast Scoreboard that scores your own forecasts.
- Honest about limits throughout: settlement selection, small samples, open cases, unrecorded facts, the weakness of judge analytics and the legal and ethical limits on it.
- Jurisdiction-neutral: the methods apply to any court system, and the course says what to check about data access and the law where you work.

Common questions
- Do I need to know statistics?
- No. The course uses plain arithmetic and explains each idea in words, then lets you work with it in a tool. The aim is to understand what a number can and cannot tell you, not to become a statistician.
- Will this predict my case?
- No, and it says so. It teaches how to start from the base rate for comparable cases, adjust for the particular facts with reasons, give a range and keep score. A forecast is an input to a decision, never a promise.
- Is it only for litigators?
- It suits litigators, in-house counsel, insurers, funders, legal operations teams, law students and anyone who advises on disputes. The portfolio chapters are especially useful for in-house and insurance work.
- Does it use real court data?
- No. All cases and figures are invented, so that no real person or court is profiled. The methods carry over to real data, and the course tells you what to check about licences, data protection and confidentiality first.
- Does it cover analysing individual judges?
- It covers why such analysis is statistically weak and ethically sensitive, that some countries restrict or prohibit it and what to do instead. It does not teach how to rank judges.
- How do I get the Certificate of Completion?
- Sign in, pass each module quiz and keep a course average of at least 75. The certificate is then issued and emailed to you automatically.
