Module 6
Risk, duties and security: using AI in legal work responsibly
Lawyers who use AI take on duties that other users do not. They hold other people’s confidences, they are responsible for the accuracy of what they give a court or a client and they are regulated in ways that vary from country to country. A workflow that is excellent technically can still be a breach of confidence, a breach of data protection law or a failure of supervision. This module sets out the main risks and the controls that answer them: confidentiality and what to read in a supplier’s terms, data protection, professional duties, questions of intellectual property, bias, the security threats that are specific to language models, the way regulation is developing and how to turn all this into a short policy and a pre-use check. It is general education: apply it with the rules that govern you.
