Module 3
Scope and applicability: does the regulation reach us, and how far?
Before a business maps a regulation it must answer a prior question: does it apply to us? The answer is often neither obvious nor permanent. Regulations draw their boundaries in different ways: by who you are (a bank, a hospital, a platform), by what you do (process personal data, offer credit), by what you sell (a medical device, a toy), by how big you are (employees, turnover, users) and by where you operate or whom you serve. Several tests may be combined, some of which must all be met, some of which are alternatives, and some of which take you out altogether. A wrong answer is costly in both directions. Treating a regulation as inapplicable when it applies invites penalties; treating one as applicable when it does not spends money and effort on controls nobody requires. This module teaches how to read the structure of a scope clause, how to handle facts that are not yet known, how groups and shared services complicate the question and how to record the decision so that it can be defended and repeated. The Scope Screener applies the logic to an invented regulation.

See what is included in All-Access →General education on regulatory mapping and compliance analytics, using invented regulations, regulators, companies and figures. It states common practice in simplified form and does not describe any one country's law, which differs and changes; rules on scope, interpretation, reporting, record keeping, monitoring of staff and penalties in particular vary. It is not legal or compliance advice, and it does not replace advice from a qualified lawyer on a real regulatory question.
