Module 4
Fairness: disclosure, the rights of the accused, victims and witnesses, and wrongful convictions
A fair trial is the point of the system, and prosecutors have more power than anyone else to make it fair or unfair. They hold the file; they know what the investigation found; they decide what the defence sees. When prosecutors do this well, the system has integrity and the public can trust verdicts. When they do not, the result is wrongful convictions, collapsed cases and cases lost on procedural grounds that should never have arisen. This module covers disclosure, the duties owed to the accused, the care owed to victims and witnesses, the particular dangers of bias and tunnel vision and what wrongful convictions have taught justice systems around the world. Rules differ by country. The principles do not.
