The Law To Know

Task Triage · For prosecutors · Free

A prosecutor’s day

The four questions, in order

  1. Question 1. Would the task put case material, or anything about victims, witnesses, informants, children or sealed proceedings, into a tool your office has not approved for it? If yes: do not give it to AI.
  2. Question 2. Does it call for your own professional judgment or decision, or a decision the law gives to a prosecutor or to the court? If yes: do not give it to AI. It may support you, but you decide.
  3. Question 3. Would you be using AI to check AI’s own output? If yes: do not give it to AI. Check against an authoritative source instead.
  4. Question 4. Otherwise, ask whether the result is quick and easy to check against a source you hold. If yes: give AI the first draft and read it. If not: use AI for leads only and verify every point against the source before relying on it.

This is a practice framework, not a rule of law or of professional ethics. Your regulator’s rules and your employer’s policy always come first. No outside law and no tools are needed: apply the four questions to each task.

  1. 1.Improve the grammar and layout of an internal training note that contains no case details.

  2. 2.Draft a plain-language explanation for victims of how a prosecution works in general, using no case details.

  3. 3.Turn your own meeting notes, with no case names, into an action list.

  4. 4.Brainstorm lines of questioning for a training exercise built on an invented case.

  5. 5.Summarise a long public inquiry report to find the sections relevant to your case.

  6. 6.Ask for authorities on a point of law, to look up yourself.

  7. 7.Translate a public foreign-language document to get the gist.

  8. 8.Draft a first timeline of a company’s history from its public filings.

  9. 9.Paste a child complainant’s witness statement into a free public AI service to summarise it.

  10. 10.Decide whether to charge, or to discontinue a case.

  11. 11.Decide whether a piece of unused material must be disclosed to the defence.

  12. 12.Ask an AI to rate whether a witness is telling the truth from the transcript of their interview.

  13. 13.Play in court a video clip that an AI tool has enhanced, without establishing how it was enhanced.

  14. 14.Ask the AI to confirm that the case you plan to cite really exists.
